Payment and Cancellation Policy
This Payment and Cancellation Policy (“Policy”) articulates the terms and conditions governing membership fees, payment protocols, refund procedures, and cancellation modalities for individuals and entities seeking or maintaining membership within ACI (Aero Club of India). By executing a membership application and remitting requisite fees, applicants and members (“Members”) acknowledge and irrevocably assent to the provisions herein.
1. Membership Fees and Payment Protocols:
- Initial Enrollment Consideration: Upon submission of a membership application, prospective Members are required to render a non-refundable admission fee, constituting a one-time charge, alongside the full annual membership dues for the inaugural membership cycle. This initial consideration serves as a prerequisite for the activation of membership privileges.
- Perpetual Annual Membership Subscription: Membership within ACI is structured on a perpetually recurring annual subscription basis. Members are under an affirmative obligation to ensure timely renewal of their membership to preserve active status and continued access to the comprehensive suite of benefits proffered by ACI.
- Authorized Remittance Modalities: All financial transactions pertaining to membership fees shall be executed exclusively through the designated electronic payment gateways or other approved payment channels as specified on ACI’s official digital platform. ACI reserves the right to modify or expand the accepted payment modalities at its discretion.
- Annual Subscription Renewal Cycle: Members bear the sole and absolute responsibility for initiating and completing renewal payments prior to the expiration of their existing membership term. Renewal dues are payable on or before the anniversary date of the Member’s original registration.
- Courtesy Payment Reminders and Member Responsibility: While ACI endeavors to provide courtesy reminders regarding impending renewal deadlines, the ultimate onus of ensuring timely financial settlement rests unequivocally with the Member. Failure to receive a reminder shall not absolve the Member of their responsibility to effectuate timely payment.
- Delinquent Dues and Membership Abeyance: In the event of a Member’s failure to remit renewal dues by the stipulated deadline, their membership shall be immediately placed in a state of abeyance. To reinstate membership privileges, the Member must discharge the aggregate annual membership dues for all lapsed years, in addition to the current year’s subscription fees.
2. Refund Policies and Procedures:
- Non-Refundable Fee Stipulation: All membership fees, including the non-refundable admission fee and annual subscription dues, are categorically non-refundable. Exceptions to this policy shall be entertained only in extraordinary circumstances and exclusively upon the express written authorization of ACI’s senior executive management.
- Executive Management Discretion: The dispensation of refunds, if any, shall be at the sole, unfettered, and non-negotiable discretion of ACI’s senior executive management.
- Refund Processing Timeline and Procedures: In instances where a refund is duly authorized by the executive management, Members should anticipate a processing period of 45-60 business days for the financial transaction to be completed. The refund shall be completed via the original payment method unless otherwise specified by ACI.
3. Membership Cancellation Protocols:
- Cancellation During Active Membership Tenure: Members may initiate cancellation proceedings exclusively during their subsisting, active membership period. Cancellations are not admissible post-expiry of the membership term.
- Formal Cancellation Procedure: To effectuate cancellation, Members must adhere to the prescribed cancellation protocol as meticulously delineated on ACI’s official website or engage with the designated member support channels.
- Settlement of Outstanding Financial Obligations: Notwithstanding the expiry of a membership term, any and all outstanding financial obligations, including but not limited to unpaid dues, must be fully discharged prior to the formalization of membership cessation.
- Non-Entitlement to Pro-Rata Reimbursement: Pro-rata reimbursements for cancellations enacted during an active membership period shall not be entertained under any circumstances.
- Consequences of Membership Cessation: Upon successful cancellation, the Member’s access to all membership privileges, benefits, and resources shall be immediately terminated at the conclusion of the prevailing membership cycle.
4. Amendments to Fees, Policies, and Regulations:
- Policy Revision and Modification Rights: ACI reserves the inalienable right to revise, modify, or amend this Payment and Cancellation Policy at its sole discretion. Members shall be apprised of any material alterations via electronic communication or through conspicuous notices prominently displayed on ACI’s official digital interface.
- Fee Adjustment Rights and Notification: ACI retains the prerogative to adjust membership subscription fees. Members shall receive advance notification of any fee modifications prior to their subsequent renewal cycle.
5. Legal Framework and Jurisdiction:
- Binding Contractual Agreement: By registering for membership and remitting payment, Members irrevocably agree to be bound by the stipulations, terms, and conditions of this Payment and Cancellation Policy.
- Jurisdictional Governance and Applicable Law: This Policy shall be construed, interpreted, and governed in accordance with the laws of the National Capital Territory of New Delhi, India.
- Dispute Adjudication and Venue: Any disputes, controversies, or claims arising from or related to this Policy shall be subject to the exclusive jurisdiction of the competent courts within the National Capital Territory of New Delhi, India.
- Severability Clause and Preservation of Provisions: If any provision of this Policy is deemed invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
- Entirety of Agreement and Superseding Provisions: This Policy constitutes the comprehensive and entire agreement between the Member and ACI pertaining to payment and cancellation matters, superseding all prior agreements, understandings, and representations.
